Service.

1. Acceptance of Terms

By accessing, browsing, or using any services provided by Sakurahost ("we", "us", "our", "the Company"), a web hosting and domain registration company registered in Arusha, Tanzania, you ("the Customer", "you", "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Sakurahost.

If you are entering into these Terms on behalf of a business, organisation, or other legal entity, you represent that you have the authority to bind that entity. If you do not agree with any part of these terms, you must not use our services.

These Terms apply to all services offered by Sakurahost, including but not limited to: shared hosting, VPS hosting, dedicated servers, web application hosting, domain name registration and transfer, business email hosting, Google Workspace reselling, SSL certificates, bulk SMS, website design and development, software licensing, and any related digital services.

2. Definitions

"Services" means any digital product or service offered by Sakurahost including hosting, domain registration, email, SSL, SMS, website design, and related services. "Account" means your registered customer account at billing.sakurahost.co.tz. "Content" means any files, data, text, images, software, or other materials uploaded, stored, or transmitted through our services. "Domain" means an internet domain name registered or transferred through Sakurahost. "Hosting" means the provision of server space, computing resources, and related infrastructure for storing and serving websites and applications.

3. Account Registration & Responsibilities

To use our services, you must create an account and provide accurate, current, and complete information including your full legal name, valid email address, phone number, and billing address. Business accounts must provide a valid business name and TIN where applicable.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any API keys. You are responsible for all activities that occur under your account, whether or not you have authorised them. You must notify us immediately at admin@sakurahost.co.tz if you suspect any unauthorised access.

You must be at least 18 years of age to create an account. If you are under 18, a parent or legal guardian must register on your behalf and accept these Terms. Sakurahost reserves the right to request proof of identity or age at any time.

You may not create multiple accounts for the purpose of abusing promotions, free trials, or circumventing account suspensions.

4. Services & Service Delivery

All Sakurahost products are digital services delivered electronically via the internet. No physical goods are manufactured, shipped, or delivered. Service activation is typically immediate for hosting, email, and SSL. Domain registrations are processed within 1–24 hours depending on the registry. Website design projects follow the timeline agreed upon at purchase.

Shared hosting accounts include cPanel access, free SSL, automated backups, email accounts, and the resources specified in the plan selected. VPS and dedicated servers include root access, the allocated CPU, RAM, and storage as advertised. Web Apps hosting includes Node.js/Next.js runtime, GitHub auto-deploy, and PM2 process management.

We reserve the right to modify, discontinue, or upgrade service offerings at any time. Existing customers will be given at least 30 days notice before any changes that materially affect their current services.

5. Domain Name Registration

Sakurahost acts as a registrar and reseller for domain name registrations. By registering a domain through us, you also agree to the terms of the relevant registry: TZNIC (Tanzania Network Information Centre) for .tz domains, and ICANN (Internet Corporation for Assigned Names and Numbers) for generic TLDs (.com, .net, .org, etc.).

Domain registration is subject to availability and acceptance by the relevant registry. We do not guarantee that a requested domain will be available or successfully registered. Domain names are registered on a first-come, first-served basis.

You represent and warrant that: (a) the information provided for domain registration is accurate and complete; (b) the domain registration does not infringe on the rights of any third party; (c) the domain is not being registered for any unlawful purpose. You agree to keep your WHOIS contact information current at all times.

Domain renewals: You are responsible for renewing your domains before expiry. We send renewal reminders at 60, 30, 14, 7, and 1 day(s) before expiry via email. Expired domains enter a grace period (varies by registry, typically 30–45 days) during which renewal may be possible at a higher fee. After the grace period, the domain enters redemption and may be permanently lost.

Domain transfers: Inbound transfers require a valid EPP/authorisation code from your current registrar. Outbound transfers will be processed within 5 days of request, provided the domain is not within 60 days of registration or a recent transfer (ICANN transfer lock policy). We will not obstruct legitimate transfer requests.

6. Payment, Billing & Pricing

All prices are listed in Tanzanian Shillings (TZS) and are inclusive of applicable taxes unless stated otherwise. We accept the following payment methods: M-Pesa, Airtel Money, Tigo Pesa (Mixx by YAS), Halotel, TTCL, Selcom, CRDB bank cards (Visa/Mastercard), and direct bank transfers.

Services are billed in advance on the billing cycle selected at checkout (monthly, quarterly, semi-annually, or annually). Invoices are generated 14 days before the due date and sent to your registered email. Payment is due on the invoice due date.

Late payments: If an invoice remains unpaid for 3 days past the due date, a reminder is sent. After 7 days, your service may be suspended. After 14 days of non-payment, we reserve the right to terminate the service and delete associated data. Reactivation after suspension may incur a reconnection fee.

Pricing changes: We reserve the right to adjust pricing with at least 30 days notice. Price increases do not apply to active billing cycles already paid. Promotional and discounted rates apply only to the initial term unless explicitly stated otherwise; renewal is at the standard rate.

Currency: All transactions are processed in TZS. For international customers, the payment gateway converts at the prevailing exchange rate. We are not responsible for exchange rate fluctuations or bank conversion fees.

7. Refund & Cancellation Policy

Shared Hosting: Same-day money-back guarantee. If you are not satisfied and request cancellation within the same calendar day of purchase, you will receive a full refund to your original payment method. After the first day, hosting fees are non-refundable for the remainder of the current billing period. Annual plans cancelled mid-term are not eligible for pro-rata refunds.

VPS & Dedicated Servers: Non-refundable once provisioned, as server resources are allocated immediately upon activation. Cancellation takes effect at the end of the current billing cycle.

Domain Registrations: Strictly non-refundable. Domains are activated immediately with the relevant registry (TZNIC, ICANN) and cannot be "unregistered." This applies to new registrations, renewals, and transfers. If a domain fails to register due to a technical error on our end, a full refund will be issued.

SSL Certificates: Non-refundable once issued by the Certificate Authority. If an SSL certificate fails to issue due to our error, a full refund or replacement will be provided.

Business Email & Google Workspace: Non-refundable once the email accounts are provisioned and active. Cancellation takes effect at the end of the billing period.

Website Design & Development: A 50% deposit is required to commence work. The deposit is non-refundable once design work has begun. The remaining balance is due upon project completion before handover. Cancellation after design commencement forfeits the deposit. If Sakurahost fails to deliver the project within the agreed timeline (plus a 14-day grace period), the customer may request a full refund of all amounts paid.

Bulk SMS Credits: Non-refundable once purchased. Unused credits remain in your account indefinitely.

How to request a cancellation or refund: Submit a support ticket at billing.sakurahost.co.tz/submitticket.php or email admin@sakurahost.co.tz. Include your account email, service details, and reason for cancellation. Refunds are processed within 7 business days to the original payment method.

8. Return Policy — Digital Services

All Sakurahost products are digital services delivered electronically via the internet. As non-tangible goods, they are not subject to physical return. Once a digital service has been provisioned — including but not limited to hosting account activation, domain name registration, email configuration, SSL certificate issuance, or SMS credit allocation — it cannot be "returned" in the traditional sense.

This is standard practice in the global web hosting and domain registration industry. Digital services are consumed upon delivery and cannot be repackaged or resold.

Refund eligibility for each service type is governed exclusively by Section 7 (Refund & Cancellation Policy) above. Where a refund is applicable, it serves as the sole remedy in lieu of a return.

This policy is consistent with Tanzanian consumer protection laws governing digital goods and electronic services, the ICANN Registrar Accreditation Agreement for domain names, and international best practices for SaaS and IaaS providers.

9. Service Level Agreement (SLA)

Sakurahost guarantees 99.9% network uptime for shared hosting, VPS, and web apps hosting services, measured monthly. "Uptime" means the server is powered on, connected to the internet, and responding to HTTP requests. Uptime is measured by our internal monitoring systems.

Exclusions: The uptime guarantee does not cover: scheduled maintenance (communicated at least 24 hours in advance); DNS propagation delays; issues caused by customer actions (misconfiguration, resource abuse, malicious scripts); force majeure events (natural disasters, power grid failures, government actions); third-party service outages (upstream providers, DNS registries).

Service credits: If uptime falls below 99.9% in any calendar month, affected customers may request a pro-rata service credit. Credits are calculated as follows: 99.0%–99.9% = 5% credit; 98.0%–99.0% = 10% credit; below 98.0% = 25% credit. Maximum credit per month is 25% of that month's fees. Credits must be requested within 14 days of the incident and are applied to your account balance (not refunded as cash).

Dedicated servers: SLA terms for dedicated servers are specified in the individual service agreement at provisioning. Standard uptime guarantee is 99.95% with hardware replacement within 4 hours.

10. Acceptable Use Policy (AUP)

You agree to use Sakurahost services only for lawful purposes and in compliance with all applicable Tanzanian and international laws. The following activities are strictly prohibited:

Illegal content: Hosting, storing, or distributing content that violates Tanzanian law, including but not limited to content related to terrorism, child exploitation, fraud, counterfeit goods, or illegal gambling.

Spam and unsolicited communications: Sending bulk unsolicited emails (spam), operating open mail relays, email harvesting, or engaging in any activity that violates the CAN-SPAM Act or equivalent Tanzanian regulations. This includes using our bulk SMS service for unsolicited messages.

Malware and hacking: Distributing viruses, trojans, ransomware, or other malicious software; attempting to gain unauthorised access to any system; port scanning; packet sniffing; IP spoofing; or conducting DDoS attacks from or against our infrastructure.

Intellectual property infringement: Hosting content that infringes copyrights, trademarks, patents, or trade secrets of others. We comply with takedown notices from rights holders.

Resource abuse: Cryptocurrency mining on shared hosting; running processes that consume excessive CPU, RAM, or I/O that degrade service for other customers; running IRC bots, game servers, or torrent clients on shared hosting. These activities are permitted on VPS and dedicated servers within your allocated resources.

Adult and offensive content: Hosting pornographic or sexually explicit material on shared hosting servers. Such content may be hosted on VPS or dedicated servers where the customer has a dedicated IP, subject to Tanzanian law.

Enforcement: Violations are handled as follows: First offence — warning and 24 hours to resolve. Second offence — service suspension pending resolution. Third offence — account termination without refund. Severe violations (malware, illegal content, fraud) result in immediate termination without warning. We cooperate fully with law enforcement investigations.

11. Resource Usage & Fair Use

Shared hosting plans are subject to fair use limits on CPU, RAM, I/O, and inodes as specified in each plan. "Unlimited" bandwidth and storage on shared plans means we will not charge overage fees for normal website hosting usage, but does not mean infinite resources. Accounts that consistently use server resources in a way that impacts other customers may be asked to upgrade to VPS.

VPS and dedicated servers: You are allocated dedicated resources as specified in your plan. You may use these resources without restriction, subject to the Acceptable Use Policy.

Backups: Shared hosting includes automated daily backups retained for 7 days. VPS includes weekly snapshots. These backups are provided as a courtesy and are not guaranteed. You are strongly encouraged to maintain your own independent backups. Sakurahost is not liable for data loss due to backup failures.

Email sending limits: Shared hosting accounts are limited to 500 outbound emails per hour to prevent abuse. Higher limits are available on VPS and dedicated servers.

12. Content & Data Ownership

You retain full ownership of all content you create, upload, store, or transmit through our services. Sakurahost claims no ownership rights over your content. By using our services, you grant us a limited, non-exclusive licence to store, cache, and serve your content solely for the purpose of providing the services you have purchased.

Upon account termination or cancellation, you have 14 days to download your data. After 14 days, your data may be permanently deleted from our servers. We strongly recommend maintaining local backups at all times.

Sakurahost retains ownership of its platform, infrastructure, software, website, branding, and all proprietary technology. You may not copy, modify, reverse-engineer, or redistribute any part of our platform.

13. Website Design & Development Terms

Website design projects are governed by these additional terms: A written or emailed brief/scope of work is agreed upon before commencement. A 50% deposit is required to begin work. The project includes up to 2 rounds of revisions. Additional revisions are billed at our hourly rate.

Timeline: Delivery timelines are specified in the project agreement (typically 5–14 business days depending on the package). Delays caused by the customer (late content submission, slow feedback) extend the timeline accordingly.

Intellectual property: Upon full payment, the customer receives ownership of the final design deliverables (HTML, CSS, images, content). Source files (PSD, Figma, raw code) are retained by Sakurahost unless explicitly agreed otherwise. Third-party themes, plugins, and stock images remain subject to their original licences.

Hosting: Website design packages include hosting and domain for the first year. Subsequent years are billed at the standard renewal rate for the included hosting plan.

14. Third-Party Services

Certain services involve third-party providers: Google Workspace is provided by Google LLC under their own terms. SSL certificates are issued by Sectigo, Let's Encrypt, or other Certificate Authorities. Domain registrations are processed through TZNIC and ICANN-accredited registries. Payment processing is handled by Selcom and mobile network operators.

Sakurahost is not responsible for changes to third-party service terms, pricing, or availability. Third-party services are subject to their respective terms and privacy policies in addition to these Terms.

15. Suspension & Termination

Sakurahost may suspend or terminate your services under the following circumstances: non-payment (see Section 6); violation of the Acceptable Use Policy (see Section 10); violation of these Terms; upon receiving a valid legal order or court directive; if your use of services poses a security risk to our infrastructure or other customers.

You may terminate your services at any time by submitting a cancellation request. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are issued for mid-cycle cancellations (except where specified in Section 7).

Upon termination: access to your account and services will be disabled; you have 14 days to request a data export; after 14 days, all data associated with your account may be permanently deleted. Domain names remain registered until their expiry date regardless of hosting account status.

16. Privacy & Data Protection

We respect your privacy and handle personal data in accordance with Tanzanian data protection regulations and international best practices. Our collection, use, storage, and sharing of personal data is described in full in our Privacy Policy, available at sakurahost.co.tz/privacy-policy.

By using our services, you consent to the collection and processing of personal data as described in our Privacy Policy. You have the right to access, correct, and request deletion of your personal data.

17. Limitation of Liability

To the maximum extent permitted by Tanzanian law, Sakurahost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, revenue, or business opportunity; loss of data or content; business interruption; damage to reputation; or any damages arising from reliance on our services.

Our total aggregate liability for any and all claims arising from or related to these Terms or your use of our services shall not exceed the total fees paid by you to Sakurahost in the 12 months immediately preceding the event giving rise to the claim.

Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free service.

18. Indemnification

You agree to indemnify, defend, and hold harmless Sakurahost, its directors, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising from: your use of our services; your violation of these Terms; your violation of any third-party rights; content you host on our servers; or any disputes between you and your end users or customers.

19. Force Majeure

Sakurahost shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, epidemics, war, terrorism, government actions, power outages, internet backbone failures, hardware failures from manufacturers, or acts of third parties. We will use commercially reasonable efforts to resume services as quickly as possible.

20. Dispute Resolution

In the event of any dispute arising from these Terms, the parties agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved within 30 days of written notice, either party may escalate to mediation through a mutually agreed mediator in Arusha, Tanzania. If mediation fails, disputes shall be resolved through the courts of Arusha, Tanzania.

21. Modifications to These Terms

Sakurahost reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes (pricing, refund policy, SLA) will be communicated via email to all registered customers at least 14 days before taking effect.

Your continued use of our services after the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using our services and request account closure.

22. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions. The courts of Arusha, Tanzania shall have exclusive jurisdiction over any legal proceedings arising from or related to these Terms.

23. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

24. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements (such as domain registration agreements or website design project scopes), constitute the entire agreement between you and Sakurahost. These Terms supersede all prior agreements, negotiations, and representations, whether written or oral.
