VPS Terms of
Service.
Version 1.0, 21 October 2026. These terms apply to every VPS you order from SakuraHost.
These terms apply to every Virtual Private Server (VPS) you order from us ("the Service"). They are in addition to our general Terms of Service. If the two conflict on a VPS matter, these terms apply. By ticking the acceptance box when you order, or by using the Service, you agree to them on behalf of yourself or the business you represent.
1. 1. What you get
1. A virtual server with the CPU, memory, storage and bandwidth stated on the product you ordered, with a fixed public IP address, supplied with the operating system you chose.
2. Root (administrator) access. You receive the login details by email once the server is ready.
3. The server runs in a data centre that we choose. We may move it to another data centre or network where this is needed for technical reasons, and will tell you in advance where we can.
2. 2. You administer the server
This is the most important section. A VPS is an unmanaged service.
1. **You are solely responsible** for administering and securing your server: its operating system, control panel, web server, database, applications, websites, email, users, passwords and keys, firewall, and everything you install on it.
2. **Security updates are your job.** You must install operating system and software security updates promptly, and you must act on security notices we send you. We cannot log in to your server, and we do not apply updates for you.
3. You must use strong, unique passwords or SSH keys, turn on two-factor authentication where available, and keep your login details confidential. We will never ask you for your server password.
4. We do not install, configure, repair or support the software you run, your websites or your data. Where we agree in writing to do extra work, it is charged separately.
5. If your server is compromised, you are responsible for cleaning it up, restoring it and notifying the people affected.
3. 3. Backups and your data
1. You must keep your own backups of everything you care about. Keep at least one copy somewhere other than your server.
2. Unless you ordered a backup option, we do not back up your server. A backup option reduces your risk but does not replace your own backups. We do not promise that any backup can be restored for every combination of software and data.
3. If your server is deleted, reinstalled, suspended and later removed, or lost for any reason, the data on it may be gone permanently. We are not liable for loss of data.
4. 4. Acceptable use
You must not use the Service, or allow others to use it, to:
1. send spam or unsolicited bulk email or messages, or operate an open mail relay;
2. attack, scan, probe or disrupt other systems or networks, including denial-of-service attacks, brute-force attempts and port scanning;
3. host or distribute malware, phishing pages, botnet or command-and-control servers, or stolen data;
4. host content that is unlawful in Tanzania or in the country where you are based, including content that infringes copyright, is obscene, incites hatred or violence, or exploits children;
5. mine cryptocurrency, or run IRC servers, Tor exit nodes, open proxies or public VPN or proxy services, unless we have agreed in writing;
6. use so much CPU, memory, disk activity or bandwidth that it harms other customers or our network;
7. break the law or the rights of anyone else, including data protection law.
5. 5. Abuse and suspension
1. If we receive a credible abuse report, or see activity that breaks section 4 or threatens our network or other customers, we may restrict, isolate or suspend your server, with or without prior notice depending on how serious and urgent the situation is. We will tell you what happened and what you must do to have the server restored.
2. If the problem is a compromised server, we may keep it isolated until you confirm it has been cleaned.
3. Your payment obligations continue during a suspension that results from your breach.
4. We may terminate immediately if you repeat or do not fix a serious breach.
6. 6. Payment, renewal and cancellation
1. You pay the price shown at order, in advance, for the billing period you chose. Prices are in the currency shown on the invoice.
2. Your VPS renews automatically for the same period unless you cancel before the renewal date. Invoices are issued before the due date. If an invoice is not paid by the due date, we may suspend the server, and after a further period of non-payment we may terminate it and delete its data. We will send reminders before we do.
3. To cancel, submit a cancellation request through your client area or write to us before your renewal date. Cancellation ends the Service at the end of the paid period. We do not refund the unused part of a paid period, except where the law requires it or where we failed to deliver the Service.
4. When the Service ends, the server and all data on it are deleted. Download what you need before then.
5. We may change prices for a renewal period by giving you at least 30 days' notice before that renewal.
7. 7. Our service commitment
1. We will use reasonable care and skill to keep the underlying infrastructure (hardware, host systems and network) available and working.
2. We cannot promise uninterrupted service. Outages can be caused by events outside our reasonable control, including failures of the data centre or network providers, power failures, attacks, and acts of nature.
3. We may carry out planned maintenance. Where it is likely to interrupt the Service for more than a few minutes, we will give notice where reasonably possible.
4. We provide support for faults on our side of the Service (infrastructure, network, billing and the control panel we supply). We do not provide support for your software or configuration.
8. 8. Data protection
1. We handle the personal information you give us to run your account in line with the Personal Data Protection Act, 2022, and our Privacy Policy. For account and billing data, we are the controller.
2. We do not access the content of your server. If you store personal data of other people on your server, you are the controller of that data and are responsible for complying with data protection law, including security and breach notification duties.
3. We may process technical data (such as IP addresses and traffic volumes) to run, secure and bill the Service, and may share information with authorities where the law requires.
9. 9. Restricted use and sanctions
You confirm that you are not acting on behalf of, and will not use the Service for, anyone who is the subject of applicable government sanctions, and that you will not use the Service for unlawful purposes. We may refuse or end the Service where we reasonably believe this is not true.
10. 10. Liability
1. Nothing in these terms limits liability that cannot be limited by law.
2. Subject to that, we are not liable for loss of data, profits, revenue, business or reputation, or for indirect or consequential loss, whether the loss arises from an outage, a security incident on your server, a suspension under these terms or anything else.
3. Our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the event that caused the claim.
4. You will compensate us for claims, losses and costs that result from your breach of section 4, or from content or activity on your server.
11. 11. Ending the agreement
1. You may end it as set out in section 6.
2. We may end it by written notice if you breach these terms and do not fix the breach within 7 days of our notice, or immediately for the serious cases described in section 5.
3. Sections that by their nature continue (including sections 3, 10 and 12) continue after the agreement ends.
12. 12. General
1. We may update these terms for legal, security or technical reasons. We will email you the changes at least 30 days before they take effect. If you do not accept them, you may cancel before they take effect. If you keep using the Service, you accept them.
2. These terms are governed by the laws of the United Republic of Tanzania. The courts of Tanzania have jurisdiction, and we will first try to resolve any dispute through good-faith discussion.
3. If any part of these terms is found unenforceable, the rest continues to apply.
4. You may not transfer the Service to someone else without our written consent.
5. We contact you at the email address on your account, and you must keep it current. Notices we send there are treated as received.
